Using AI in Your Business? Don't Overlook the Legal Side.
AI can help you start, run and grow your business. But are you ready for the legal responsibilities that come with it?
Legally She Can is a Swiss-based legal consultancy in Zurich. We help founders and experts serving clients in Switzerland and the EU address the legal and trust risks of using AI in their businesses.
QUICK ANSWERS: USING AI IN YOUR BUSINESS
Q1: Can I use AI to start and build my business?
Yes. But AI doesn't take responsibility for the decisions you make with it. Whether you're developing offers, publishing a website or selling internationally, you still need to make sure your business can deliver what it promises.
Q2: Can I put client information into ChatGPT or other AI tools?
Not automatically. Before sharing information, check whether you're allowed to share it, how the AI provider handles it, and whether this still matches what you've promised your clients.
Q3: Can I let an AI agent or chatbot work directly with my clients?
Yes, but this changes your exposure. When AI starts speaking or acting for your business without you checking every response, you need boundaries on what it can say, do and access, and a plan for when something goes wrong.
AI MAKES THINGS EASIER. BUT IT DOESN'T TAKE ON YOUR RESPONSIBILITIES.
You can now use AI as your business coach, website builder, marketing assistant and even your little employee.
It can suggest what to sell, build your digital systems and help you serve clients without having to hire a whole team.
And that is exciting, especially when you're running a business on your own.
But there's something you may not have considered.: AI gives you the output. What it doesn't necessarily give you is an understanding of the decisions, processes and legal responsibilities behind that output.
And when something goes wrong, you cannot simply say, "AI did it."
HOW ARE YOU USING AI IN YOUR BUSINESS?
AI is helping me decide what to sell
AI can suggest new services, pricing and international markets. But when you turn those ideas into actual offers, your contracts, client promises and consumer obligations need to match.
I'm using ChatGPT with client information
AI can help you summarise documents, prepare proposals and analyse information. But using client information may involve confidentiality, contractual restrictions and data protection obligations.
AI is building my website or systems
Your AI-built website may look professional and work perfectly. But who collects the personal data? Which platforms process it? And do your privacy policies match what actually happens?
AI is starting to work for my clients
A chatbot, agent or app can answer questions, recommend services and perform tasks. But what happens when it makes a mistake, shares information or promises something you didn't authorise?
WHERE SHOULD YOU START WITH THE LEGAL SIDE?
USING AI TO DEVELOP OFFERS AND CLIENT SERVICES?
AI may help you create your business model, services, pricing and client agreements.
But do those arrangements actually protect your business and reflect what you deliver?
Client Ready focuses on the legal foundations of your client relationships, including agreements, scope, payment terms, cancellations and the commitments you're making.
USING AI TO BUILD YOUR WEBSITE OR HANDLE CLIENT INFORMATION?
If you're using AI to build your website, set up digital systems or work with client information, you need to understand what happens behind the scenes.
Digital Ready helps you address the data protection and legal setup of your digital operations, including providers, data flows, website policies and relevant GDPR and Swiss FADP obligations.
WHAT IF YOU'RE BUILDING AN AI CHATBOT, AGENT OR APP FOR CLIENTS?
Using ChatGPT for your own work is different from creating an AI app, chatbot or agent for clients.
If you’re planning or building one, AI Ready Diagnostic helps identify legal issues early.
If it’s already built, in testing or live, Legally Fluent Founder: AI Ready may be the right route.
Our AI app and chatbot page helps you choose where to start.

THINKING ABOUT BUILDING YOUR OWN AI APP, CHATBOT OR AGENT?
From ChatGPT to AI Agents: What Changes in Your Business?
You've used ChatGPT to write content or brainstorm ideas. Now you're hearing about AI agents, apps and automations that can actually do work for your business.
But what changes when AI moves from helping you think to carrying out tasks on your behalf?
In this webinar, we explore two questions every business owner should consider:
What are you allowing AI to touch?
Does your business setup still hold up once it does?
Whether you're just getting started or considering your own AI agents and apps, this webinar helps you understand the decisions and responsibilities that come with using AI in your business.

Can I Put Client Information into ChatGPT?
Not automatically.
Before uploading client information into ChatGPT, Claude or another AI tool, consider what information you're sharing, whether you have the right to share it, the provider's terms and what happens to that information.
Even when the information is not personal data, it may still be confidential or subject to contractual restrictions.
You also need to consider which data protection laws apply and whether the provider's arrangements are appropriate for your intended use.
If you're using AI as part of your everyday business operations, Legally Fluent Founder: Digital Ready may be the relevant starting point.
AI Wrote My Contracts and Privacy Policy. Isn't That Enough?
AI can help you draft legal documents. But it doesn't automatically know how your business operates, what your clients have agreed to, which countries you're targeting or what your digital providers actually do with personal data.
The document may look professional and still contain gaps, incorrect assumptions or promises your business cannot fulfil.
What matters is not just how the document reads, but whether it accurately reflects the business you're running and meets the legal requirements that apply.
When Should I Look at the Legal Side of Using AI?
Ideally, before your AI-assisted decisions become commitments to real clients.
That may be when you're launching a new offer, targeting customers in another country, connecting digital tools to your website or allowing AI to access client information.
And if you're building something that will interact directly with clients, it's better to address the legal setup while changes can still be made.
The earlier you understand the responsibilities, the easier it is to make informed decisions about what AI should and shouldn't do in your business.

FREQUENTLY ASKED QUESTIONS
Is it legal to use ChatGPT or other AI tools for my business?
Generally, yes. But how you use AI matters.
Using it to brainstorm ideas is different from sharing confidential client information, making automated decisions or allowing an AI chatbot to interact with customers.
Your legal responsibilities depend on the activity, the information involved and the laws and contractual obligations that apply.
Does using AI automatically mean I have to comply with the GDPR?
No. Using AI does not automatically make the GDPR applicable to every business.
Whether it applies depends on factors such as an establishment in the EU, offering goods or services to people in the EU, or monitoring their behaviour.
The Swiss FADP has its own scope of application. You need to assess the legal framework relevant to your business and how it processes personal data.
Can I use AI to create offers for clients in other countries?
Yes, but selling internationally can introduce additional legal responsibilities.
For example, actively targeting consumers in another country can trigger consumer protection requirements that affect your contracts, cancellation rights and refunds.
AI may make it easier to reach new markets. That doesn't mean the legal requirements are the same everywhere.
Do I have to tell clients that I use AI?
It depends on what the AI does and which legal obligations apply.
Using AI to help prepare your own work is different from having a chatbot communicate directly with clients or allowing an automated system to make decisions affecting them.
Some uses require specific transparency measures or disclosures. Your contracts and existing confidentiality obligations may also affect what you need to communicate.
Make AI Work for Your Business Without Overlooking the Legal Risks
AI can help you do more with less. But the more you allow it to do, the more important it becomes to understand the responsibilities that remain yours.
Whether you're using AI to develop offers, build your website or create tools that interact with clients, Legally She Can can help you understand what legal safeguards your business needs.
You don't have to figure out the legal side on your own.
